No One is Above the Law

The rights of every American are clearly defined in Declaration of Independence and The Constitution of the United States. Essentially they state that we are endowed by our Creator with certain unalienable rights. These rights include life, liberty and the pursuit of happiness. At that time, James Madison was very concerned that the statement of this idea as it is expressed in the second paragraph of the Declaration of Independence would be misinterpreted. He feared that Americans would believe that life, liberty and the pursuit of happiness were the only rights they were granted by God. So to make it clear that life, liberty, and the pursuit of happiness were simply three of our numerous birth rights, he wrote the Amendment IX in the Bill of Rights in the Constitution.


The role of the government is also clearly defined in the Declaration of Independence and The Constitution of the United States. Essentially they state that the government’s role is to assist Americans in securing their rights ― all of the rights. And they state that government, which gets its power from the people, must promote the general welfare, ensure the safety and happiness of everyone, and guarantee all of them equal protection under the laws.

No government official at the local, state, of federal level has the rights to willfully violate these statutes in the Declaration of Independence and The Constitution of the United States. No one ― including the governor of Wisconsin ― has the authority to promote the general welfare of one group of citizens (rich Americans) at the expense of other groups (middle and working class Americans).

I am convinced that Governor Scott Walker’s budget repair bill is in violation of the Equal Protection Clause of the Fourteenth Amendment, because it intentionally and unnecessarily subjects the middle class and the poor to an undue burden for the purpose of lavishing lucrative tax breaks on rich Americans. I am angry and frustrated that none of the leaders in the Democratic Party is suing Governor Walker in a federal court. This isn’t the first time that Governor Walker has violated the Equal Protection Clause. He did it many times in his previous job. And he bragged about it many times in his speeches. He is not above the law, and he should be held accountable for breaking the law ― like you and I would be!
